Amends TCA Title 3; Title 8; Title 16 and Title 50.

This bill creates a program for paid family medical leave for state employees. <br /> <br /> Under present law, each officer and employee of the several departments and agencies of the state government, who is scheduled to work 1,600 hours or more in a fiscal year, accrues one day of sick leave for each month worked and a varying amount of annual leave, based on length of service, for each month worked. Present law authorizes state employees to use annual leave and sick leave for up to 12 weeks of maternity, paternity, or adoptive parent leave.<br /> <br /> This bill adds that an eligible employee will be granted absence from work with pay for the following:<br /> <br /> (1) Twelve workweeks after the birth of the employee's newborn child or adoption of a newly placed minor six years of age or younger, subject to certain notice requirements; <br /> <br /> (2) One workweek for a serious health condition of the employee, employee's spouse, employee's child, or employee's parent, subject to certain notice requirements and appropriate medical certification from a healthcare provider; and <br /> <br /> (3) Six hours for an employee who is a parent or caregiver to attend a school-related activity of the employee's child or child for whom the employee is a caregiver, subject to certain notice requirements and documentation from the child's teacher or other person responsible for the activity's scheduling. <br /> <br /> This bill defines a serious health condition as a condition that requires an overnight stay in the hospital or other medical care facility, a condition that incapacitates a person for more than three consecutive days and requires ongoing medical treatment, a chronic condition that causes occasional periods when a person is incapacitated and requires treatment from a healthcare provider at least four times a year, and pregnancy.<br /> <br /> The leave extended to state employees by this bill:<br /> <br /> (1) Must not be charged to any sick, annual, or other leave the employee may have accumulated;<br /> <br /> (2) Counts toward the eligible employee's use of FMLA leave; and<br /> <br /> (3) Must not be granted more than once in a 12-month period.<br /> <br /> This bill defines "eligible employee" to include employees with 12 months or more service in state service, the legislative branch, the judicial branch, the offices of the constitutional officers, the offices of the district attorneys general and the district public defenders, THEC, TACIR, THDA, and TRICOR.<br /> <br /> This bill requires the department of human resources to establish policies for implementing this bill with regard to the executive branch agencies. For nonexecutive branch agencies, this bill requires the agency's equivalent of the human resources office to establish the policies for implementing this bill.<br /> <br /> This bill applies to any eligible employee who qualifies for leave under this bill beginning July 1, 2023.<br />
