Amends TCA Title 71, Chapter 4, Part 8.

Present law authorizes the state treasurer to establish a qualified ABLE program to assist an eligible individual in saving money to meet the individual's expenses related to the individual's blindness or disability, including expenses for education; housing; transportation; employment training and support; assistive technology and personal support services; health; prevention and wellness; financial management and administrative services; legal fees; oversight and monitoring; funeral and burial; and others approved by federal rules and regulations. This bill prohibits the following conduct by the state following the death of an eligible individual who is the designated beneficiary of a qualified ABLE account: (1) Seeking recovery of an account balance remaining in the account for medical assistance paid to, or on behalf of, the designated beneficiary on or after the date the participation agreement was entered into and the account was established for the designated beneficiary, except as required by federal law; or (2) Filing a claim for payment under federal law provisions concerning qualified ABLE programs.
