Amends TCA Title 49.

Under present law, if a public school established under the jurisdiction of an LEA is a member of an organization or association that regulates interscholastic athletic competition, and if the organization or association establishes or maintains eligibility requirements for home school students desiring to participate in interscholastic athletics at a member school, then the LEA must permit participation in such athletics at the school by home school students who satisfy those requirements. However, this provision does not guarantee that the home school student will make the team, nor does this provision supplant the authority of coaches or school officials in deciding who makes the team. PARTICIPATION IN ALL OFFERED ACADEMIC, ARTS, OR ATHLETIC PROGRAMS, CLUBS, EVENTS, AND OPPORTUNITIES This bill requires each LEA and public school, including a public charter school, to provide home school students, and students who transfer into the LEA or school, in good academic standing with equal access to all academic, arts, or athletic programs; clubs; events; and opportunities offered by the LEA or school as provided to enrolled non-transfer students. This bill clarifies that such students are immediately eligible to participate in such programs, clubs, events, and opportunities but that an LEA or school is not required to guarantee such students a place or position on a team, club, or organization For purposes of this bill, the LEA for such a home school student is the LEA in which the student was most recently enrolled or the LEA in which the home school student resides. ON MARCH 6, 2023, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 443, AS AMENDED. AMENDMENT #1 revises this bill to apply the provisions to transfer students and home school students, regardless of whether such students are in good academic standing, who enroll or re-enroll in the LEA or public charter school.
