Amends TCA Title 2 and Title 5.

Present law generally provides that if governmental entities have a charter provision for a petition for recall, referendum, or initiative, or persons act pursuant to such charter provisions, then, in addition to other requirements, the petition must be signed by at least 15 percent of registered voters in the municipality or county. However, present law also provides an exception to this statutory minimum number of signatures requirement if the municipality or county enacted a contrary charter provision after July 1, 1997. This bill removes the exception for counties but also provides an alternative manner to satisfy the minimum number of signatures requirement by instead allowing petitions to be signed by at least 1 percent of the registered voters in the county if a county legislative body passes a resolution of no confidence in a county officer. The bill further provides that the disqualification of one or more signatures does not render such petition invalid but disqualifies those signatures from being counted toward the minimum number of signatures requirement.
