Amends TCA Title 71, Chapter 3.

Present law requires all persons or entities operating a child care agency to be licensed by the department of human services. Present law generally defines a "child care agency" to refer to a place or facility, regardless of whether it is currently licensed, that is operated as a family child care home, a group child care home, a child care center, or a drop-in center, or that provides supervision, protection, and, at a minimum, the basic needs, of children for less than 24 hours a day, for five or more children who are not related to the primary caregiver for three or more hours per day. This bill increases the minimum number of children a facility must have under its care for three or more hours per day in order to fall within the definition of a "child care agency" for licensing purposes from five to seven.
