Amends TCA Title 68, Chapter 104.

Present law generally prohibits shipment of fireworks into, and sales of fireworks in, counties and municipalities that have prohibited such sales in their jurisdictions. With regard to Williamson and Hamblen counties, present law specifies that sale and possession of fireworks in such counties is lawful unless the applicable local government prohibits such sales and possession. This bill deletes the county-specific provision to clarify that sales in all municipalities and counties are subject to the same standard regarding local prohibitions. Present law specifically authorizes the sale of fireworks to continue at a stand located on property over which there is a jurisdictional dispute, where fireworks have been sold for 45 years or more, and that is located in a municipality in Hamilton, Knox, Davidson, or Shelby counties, if the municipality had a population of 600-620 at the time of a census conducted from 1980 to the present and permitted sales of fireworks before 1984. This bill deletes such provision so that fireworks sales at any such location will be governed by the applicable county law or municipal ordinance.
