Amends TCA Title 29 and Title 66.

ON MARCH 20, 2023, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 988, AS AMENDED. AMENDMENT #1 rewrites this bill to require a landlord to provide a tenant with 90 days' notice of termination of lease tenancy for the purpose of eviction of a residential tenant of a facility that provides housing for persons aged 55 years or older and receives federal financial assistance that subjects it to Section 504 of the Rehabilitation Act of 1973 (which generally prohibits organizations and employers from excluding or denying individuals with disabilities an equal opportunity to receive program benefits and services) if the tenant has paid the tenant’s rent due and is not in arrears on rent payments and the termination and eviction are to allow for new property development. This amendment does not abrogate a landlord’s right to terminate a tenancy for a violation of another law or of the lease or tenancy agreement. This bill applies to agreements entered into, amended, or renewed on or after July 1, 2023. ON APRIL 3, 2023, THE SENATE SUBSTITUTED HOUSE BILL 988 FOR SENATE BILL 717, ADOPTED AMENDMENT #1, AND PASSED HOUSE BILL 988, AS AMENDED. AMENDMENT #1 incorporates the changes made by House Amendment #1 but reduces the period for notice of termination of tenancy from 90 to 60 days. ON APRIL 19, 2023, THE HOUSE REFUSED TO RECEDE IN ITS NONCONCURRENCE AND APPOINTED A CONFERENCE COMMITTEE. ON APRIL 21, 2023, THE HOUSE ADOPTED THE CONFERENCE COMMITTEE REPORT AND MADE IT THE ACTION OF THE HOUSE. ON APRIL 21, 2023, THE SENATE ADOPTED THE CONFERENCE COMMITTEE REPORT AND MADE IT THE ACTION OF THE SENATE.
