Amends TCA Title 8, Chapter 33 and Title 8, Chapter 50, Part 8.

Present law generally provides the following concerning the accrual of annual leave for eligible state employees and officers:<br /> <br /> (1) An officer or employee who has less than five years of full-time service and was not in the active employment of the state on July 1, 1969, accrues annual leave at the rate of one day for each month of service or major fraction thereof, and may accumulate a maximum of 30 work days;<br /> <br /> (2) An officer or employee who has less than five years of full-time service and was an active employee of the state on July 1, 1969, and has had continuous employment since July 1, 1969, accrues annual leave at the rate of one and one-half days for each month of service or major fraction thereof, and may accumulate a maximum of 36 work days;<br /> <br /> (3) An officer or employee who has five years and less than 10 years of full-time service accrues annual leave at the rate of one and one-half days for each month of service or major fraction thereof and may accumulate a maximum of thirty-six (36) work days;<br /> <br /> (4) An officer or employee who has 10 years and less than 20 years of full-time service accrues annual leave at the rate of one and three-quarters days for each month of service or major fraction thereof and may accumulate a maximum of 39 work days;<br /> <br /> (5) An officer or employee who has 20 years or more of full-time service accrues annual leave at the rate of two days for each month of service or major fraction thereof and may accumulate a maximum of 42 work days; and<br /> <br /> (6) Weekends and official holidays are not counted in computing the period of time to which an officer or employee is entitled, unless the days are considered as work days;<br /> <br /> Present law generally provides the following concerning the accrual of sick leave for eligible state employees and officers:<br /> <br /> (1) Sick leave is cumulative for all earned days not used. Weekends and official holidays falling within a leave period are not charged as leave, unless such days are considered as work days; and<br /> <br /> (2) Each officer and employee who is employed full time and who has accumulated the maximum number of allowable annual leave days shall have any additional leave days accrued in excess of the maximum amount transferred annually to the officer's or employee's credit as sick leave.<br /> <br /> This bill changes the current law by providing that a full-time state employee who is a member of a reserve component of the armed forces of the United States, including the Tennessee army and air national guard, continues to accrue annual and sick leave the state employee would ordinarily accrue pursuant to the provisions above during a period of absence from the state employee's respective duties for all periods of military service during that the state employee is engaged in the performance of duty or training in the service of this state, or of the United States, under competent orders. For purposes of this new provision, the bill defines a "state employee" as a person who is:<br /> <br /> (1) A state official, including the attorney general and reporter, district attorneys general, state judges, and district public defenders;<br /> <br /> (2) Employed by the state and whose compensation is payable by the state or is paid in whole or in part from federal or other funds; or<br /> <br /> (3) Employed by a public institution of higher education and whose compensation is payable by the institution or is paid in whole or in part from federal or other funds.<br />
