Amends TCA Title 36 and Title 37.
Present law requires the department of children's services to file a petition to terminate the parental rights of the child's parents, or, if such a petition has been filed by another party, seek to be joined as a party to the petition, and, concurrently, to identify, recruit, process, and approve a qualified family for an adoption, under certain circumstances. This bill adds as an additional circumstance requiring the department to take such action when there has been substantial noncompliance by the parent or guardian with the statement of responsibilities in a permanency plan pursuant to laws governing foster care, and the period of time originally established in the child's permanency plan has elapsed.
