Present law generally classifies as confidential and not open for public inspection personal information contained in motor vehicle records. The Uniform Motor Vehicle Records Disclosure Act defines "personal information" to mean information that identifies a person, but not information on vehicular accidents, driving or equipment-related violations, and driver license or registration status. The Act authorizes disclosure of personal information contained in motor vehicle records with the consent of the person who is the subject of the information or for the following purposes:<br /> <br /> (1) Matters of motor vehicle or driver safety and theft, motor vehicle emissions, motor vehicle product alterations, recalls, or advisories, performance monitoring of motor vehicles and dealers by motor vehicle manufacturers, and removal of nonowner records from the original owner records of motor vehicle manufacturers to carry out the purposes of federal law. The disclosure of personal information under this exception is limited to 12 circumstances that are listed in the full text of Tennessee Code Annotated, Section 55-25-107(b); and<br /> <br /> (2) Matters concerning the federal selective services system.<br /> <br /> This bill requires the office of open records counsel, in coordination with the departments of safety and revenue, to develop and maintain a system to track bulk purchases of public records containing personal information from state motor vehicle records and authorized for release under present law. The tracking system must include:<br /> <br /> (1) The name and contact information of every person or entity who makes recurrent bulk purchases of public records containing personal information from state motor vehicle records;<br /> <br /> (2) The amount of information requested by such person or entity during the prior calendar year; and<br /> <br /> (3) Any other information the office of open records counsel and the departments of safety and revenue deem relevant.<br /> <br /> This bill also requires the office of open records counsel to post monthly on the office's public website the most recent information collected under this bill and maintain the information collected under this bill on its website for five years from the month the information is originally posted.<br />
