Amends TCA Title 29, Chapter 34.
Present law provides that a charitable organization providing services to the community is not liable for a loss, damages, injury, or death that results from providing services, unless the charitable organization's conduct in providing services constitutes gross negligence or willful and wanton misconduct. Present law defines "services" as providing food; housing; or shelter from adverse weather. This bill clarifies that providing shelter from adverse weather includes, but is not limited to, allowing persons to enter the premises for purposes of temporary shelter from severe storms.
