Amends TCA Title 39.
Present law provides that, except as otherwise provided by state law or as specifically provided in existing law, the general assembly preempts the whole field of the regulation of firearms, ammunition, or components of firearms or ammunition, or combinations thereof, to the exclusion of all county, city, town, municipality, or metropolitan government law, ordinances, resolutions, enactments or regulation. Present law prohibits any county, city, town, municipality, or metropolitan government nor any local agency, department, or official from occupying any part of the field regulation of firearms, ammunition or components of firearms or ammunition, or combinations thereof.<br /> <br /> However, this bill authorizes a city, county, town, municipality, or metropolitan government to regulate by ordinance, resolution, policy, rule or other enactment the storage of a firearm in a motor vehicle when the motor vehicle is unoccupied. This bill applies only in counties having a population greater than 98,800, according to the 2020 or a subsequent federal census. Currently, this bill only applies in Madison County, Maury County, Bradley County, Washington County, Blount County, Wilson County, Sullivan County, Sumner County, Montgomery County, Williamson County, Rutherford County, Hamilton County, Knox County, Davidson County, and Shelby County. A person who is in full compliance with an ordinance, resolution, policy, rule, or other enactment passed pursuant to this bill, as established by clear and convincing evidence, is immune from civil liability with respect to any claim based on the theft of such person's firearm while the person is not in the motor vehicle.<br />
