Amends TCA Title 37.
Present law provides that unless a child found to be dependent or neglected is found also to be delinquent, the child must not be committed to or confined in an institution or other facility designed or operated for the benefit of delinquent children. This bill adds that a child found to be dependent or neglected must not be committed to or confined to such an institution unless the court finds by a preponderance of the evidence that the child may pose a risk of harm to the child's self or others and is in need of intensive services or the child is also found to be delinquent.
