Amends TCA Title 39 and Title 40.

Present law provides that a person commits criminal impersonation who pretends to be a law enforcement officer for the purpose of (i) engaging in an activity that is ordinarily and customarily an activity established by law as a law enforcement activity and (ii) causing another to believe that the person is a law enforcement officer. Such criminal impersonation is a Class A misdemeanor. However, if any person commits criminal impersonation of a law enforcement officer while operating a motor vehicle with lights indicative of a law enforcement officer vehicle, then the maximum fine for the offense is $5,000. This bill clarifies that a "law enforcement activity," as used in the present law, includes operating a motor vehicle that displays logos, decals, or insignia that give the appearance of a motor vehicle operated by a law enforcement officer or operating a motor vehicle in violation of existing law relative to lights indicative of a law enforcement officer vehicle. This bill further clarifies that it is not a defense that the motor vehicle used in the violation was purchased from a law enforcement agency. This bill applies to offenses committed on or after July 1, 2024.
