Amends TCA Title 49, Chapter 6, Part 38.

ON MARCH 28, 2024, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 1858, AS AMENDED. AMENDMENT #1 rewrites the bill to, instead, provide that a student, a student's parent or guardian, or a school employee has standing to file a civil action against the LEA or public charter school in which the student is enrolled, or the school employee is employed, in a chancery court of competent jurisdiction if the LEA or public charter school fails to implement the requirements of the Age-Appropriate Materials Act of 2022. However, this amendment does not create a right to appeal a determination made by a local board of education, public charter school governing body, or the state textbook and instructional materials quality commission concerning the age-appropriateness or suitability of a material in a school library collection to a chancery court.
