Amends TCA Title 4 and Section 29-34-213.
Present law provides that a charitable organization providing food, housing, or shelter from adverse weather to the community is not liable for a loss, damages, injury, or death that results from providing services, unless the charitable organization's conduct in providing services constitutes gross negligence or willful and wanton misconduct. This bill authorizes such a charitable organization to use an official state logo or emblem for purposes of such services as described below. OFFICIAL STATE LOGO OR EMBLEM For purposes of authorizing a charitable organization providing community services as described above to use an official state logo or emblem, this bill authorizes a state department, agency, or official to permit the use of such logo or emblem at no cost to the charitable organization, or to enter into a contract or agreement with a private entity or the charitable organization for such use. Such a charitable organization may enter into a contract or agreement with, or seek permission from, a private entity or a state department, agency, or official for purposes of authorizing the charitable organization to use an official state logo or emblem. This bill provides that if contracting for, authorizing, or permitting the use of an official state logo or emblem under this bill requires state funding, then such funding must come from within the existing resources of the respective state department, agency, or official's office contracting for, authorizing, or permitting such use.
