Amends TCA Title 28; Title 39 and Title 40.

This bill requires a civil action for an injury or illness based on an offense involving rape or sexual battery ("sexual assault") that occurred when the injured person was 18 or older to be brought as follows:<br /> <br /> (1) Within three years of the sexual assault, or last act of sexual assault if in a series of continuing sexual assault incidents against the victim by the alleged perpetrator, if law enforcement was not notified of the sexual assault; or<br /> <br /> (2) Within five years of the sexual assault, or last act of sexual assault if in a series of continuing sexual assault incidents against the victim by the alleged perpetrator, if law enforcement was notified of the sexual assault.<br /> <br /> ON MARCH 7, 2024, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 2060, AS AMENDED.<br /> <br /> AMENDMENT #1 names the bill "Danielle's Law" and clarifies that the bill applies to offenses committed on or after the bill takes effect.<br />
