Amends TCA Title 4.

STREAM ACT<br /> <br /> This bill, the State of Tennessee Real Estate Asset Management (STREAM) Act, authorizes new powers for the commissioner of general services. Under this bill, the commissioner is permitted to do the following: <br /> <br /> (1) Administer general custodial care and decision-making responsibility for all executive branch leases, acquisitions, and disposals of real property, and exercise responsibility for agency compliance with state building commission policy requirements on land and lease acquisitions and disposals; <br /> <br /> (2) Provide state executive branch agencies with additional support services for real property that are not otherwise assigned by law to other departments or divisions;<br /> <br /> (3) Approve construction delivery methods for projects under the commissioner's control that include, but are not limited to, design/bid/build, design/build, public-private partnerships, best value, construction manager/general contractor, and job order contract; <br /> <br /> (4) Approve financial incentives for the early completion of capital projects under budget and in accordance with agreed upon construction schedules, notwithstanding other law or policy to the contrary; and<br /> <br /> (5) Promulgate rules in accordance with the Uniform Administrative Procedures Act, and establish policies to effectuate this bill.<br /> <br /> MAJOR MAINTENANCE<br /> <br /> Under present law, pertaining to the state building commission, "major maintenance" means the repair or renovation of a building or structure or a portion thereof in which this state or a department, institution, or agency thereof has an interest and that (i) is being funded by direct appropriations for major maintenance; (ii) will cost state departments, colleges of applied technology, and public two-year institutions of higher learning in excess of $250,000 for a structure or $1,000,000 for a project excluding furniture and equipment; or (iii) will cost public four-year institutions of higher education in excess of one million dollars for a structure or $3,000,000 for a project excluding furniture and equipment.<br /> <br /> This bill removes and changes the second part of this definition, providing, instead, that "major maintenance" means the repair or renovation of a building or structure or a portion thereof in which this state or a department, institution, or agency thereof has an interest and that will cost state departments, colleges of applied technology, and public two-year institutions of higher learning in excess of $1,000,000 for a structure or $3,000,000 for a project excluding furniture and equipment.<br />
