Amends TCA Title 8 and Title 49.
Present law authorizes a retired member or prior class member of the Tennessee consolidated retirement system (TCRS), and any retiree of a local retirement fund receiving benefits to return to service temporarily in a position covered by the TCRS and continue to draw such person's retirement allowance (i) if during a 12-month period, that person does not work more than 120 days or the equivalent of 120 days; or (ii) if employed as a teacher by an institution of higher learning, does not exceed 24 quarter credit hours or 18 semester credit hours. This bill authorizes a retired member to work in addition to the 120-day limitation if employed in a public school system as a substitute teacher, a school bus driver, or a cafeteria worker if the compensation payable to the retired member for such work does not exceed the rate of compensation set by the public school system for similar vacant positions; and, if the member is employed as a substitute teacher, that the total salary paid to any such retired member during the 12-month period does not exceed the pertinent pro rata share of average salary being paid at the institution in the academic discipline concerned. Present law authorizes a retired member of the TCRS or of a superseded system, or of an established local retirement fund to be reemployed in a position covered by the retirement system without the loss or suspension of the retired member's TCRS benefits if the retired member is reemployed as a K-12 teacher, as a K-12 substitute teacher, or as a K-12 school bus driver. This bill adds that a retired member of the TCRS or a superseding system may also be employed as a cafeteria worker under this bill without loss or suspension of the member's system benefits.
