Amends TCA Title 49.

This bill authorizes a Tennessee comprehensive assessment program (TCAP) test to be administered to students enrolled in a virtual school or virtual education program through the internet in a virtual or remote setting, but only if the following criteria are met: (1) The assessment is administered to students on a specific date, and at a specific time, scheduled by the virtual school, or by the public school providing the virtual education program, during the same test administration window designated by the commissioner of education for TCAP assessments; (2) The assessment is administered to students during a synchronous assessment session initiated and managed by the virtual school, or by the public school providing the virtual education program, that is attended by each student administered the assessment in a virtual or remote setting; (3) The assessment is generally administered to students through computer hardware or through a technological device that allows the student to be monitored by the assessment proctor through audio and visual means for the duration of the assessment's administration; (4) The virtual school, or the public school providing the virtual education program, strives to maintain a student to assessment proctor ratio of no less than one assessment proctor for every 10 students; (5) The virtual school, or the public school providing the virtual education program, does not allow a student who is being administered a TCAP test in a virtual or remote setting to exit the assessment's administration until instructed to do so by the assigned assessment proctor; and (6) The submission of a TCAP test administered to students in a virtual or remote setting is verified by the assessment administrator. This bill provides that if the assessment platform does not allow for integrated camera proctoring for purposes of (3), then the student must use two devices for the duration of the assessment's administration. The student must be administered the assessment on one device and monitored by the assessment proctor through audio and visual means through the second device. However, this provision does not require the use of a second device if the assessment platform allows for the assessment proctor to view the student and the student's background during the assessment's administration. This bill applies to TCAP tests administered to students in the 2024-2025 school year and each school year thereafter.
