Amends TCA Title 4; Title 63 and Title 68.
BOARD OF PHARMACY Present law requires the board of pharmacy to consult with the division of health-related boards in the department of health in appointing a person to serve as executive director of the board. However, the board is not bound by any recommendation of the division. The executive director must be licensed as a pharmacist in this state for at least five consecutive years immediately preceding the appointment. This bill requires that once appointed, the executive director must operate under the supervision and control of the division of health-related boards. BOARD OF NURSING Present law provides that the board of nursing has the power and duty to employ, in consultation with the governor, an executive director, who must not be a member of the board, although the board is not bound by any recommendation of the governor. The executive director must receive a salary to be fixed by the board and approved by the commissioner of human resources and the commissioner of finance and administration. This bill removes the provision above relative to salary and provides that, once appointed, the executive director must operate under the supervision and control of the division of health-related boards.
