Amends TCA Title 4; Title 8 and Title 10, Chapter 7, Part 5.

Present law provides that the following records or information of any state, county, municipal or other public employee or former employee, or applicant to such position, of any law enforcement officer commissioned by governing boards or by institutions and schools governed by the boards, or of any federal law enforcement agent or officer conducting an operation in this state, in the possession of a governmental entity or any person in its capacity as an employer must be treated as confidential and not be open for inspection by members of the public: (1) Home telephone and personal cell phone numbers; (2) Bank account and individual health savings account, retirement account and pension account information; provided, that nothing limits access to financial records of a governmental employer that show the amounts and sources of contributions to the accounts or the amount of pension or retirement benefits provided to the employee or former employee by the governmental employer; (3) Social security number; (4) Residential information, and residential street address for any county, municipal or other public employee; (5) Driver license information except where driving or operating a vehicle is part of the employee's job description or job duties or incidental to the performance of the employee's job; (6) The information listed in (1)-(5) above of immediate family members, whether or not the immediate family member resides with the employee, or household members; (7) Emergency contact information, except for that information open to public inspection in accordance with (4) above; and (8) Personal, nongovernment issued, email address. This bill provides that the information listed in (1)-(8) above pertaining to an active or former commissioned law enforcement officer, photographs of such law enforcement officer, and the name and location of each school and day care facility attended by a child of such law enforcement officer must also be maintained confidentially by a state or local department or agency in possession of such information upon receipt of a written request by the law enforcement officer to whom such information pertains. The written request must meet the following criteria: (1) Be accompanied by a letter from the chief executive of the officer's current or former employing department or agency verifying the officer's current or former employment; and (2) Be submitted to the state or local department or agency by mail, electronically, or in person.
