Amends TCA Title 39, Chapter 17.
ADDING PROHIBITED WEAPONS<br /> <br /> Present law provides that a person commits an offense who intentionally or knowingly possesses, manufactures, transports, repairs, or sells an explosive or an explosive weapon; a device principally designed, made, or adapted for delivering or shooting an explosive weapon; a machine gun; hoax device; knuckles; or any other implement for infliction of serious bodily injury or death that has no common lawful purpose.<br /> <br /> This bill adds to the list in the above provision a switch or auto sear device designed, made, or intended for use in converting a weapon to shoot automatically more than one shot, without manual reloading, by a single function of the trigger; or a firearm built from a weapon parts kit and not marked with a serial number. The intentional or knowing possession, manufacture, transport, repair, or sale of such items constitutes a Class E felony and, in addition to any authorized period of incarceration, is punishable by a mandatory fine of $10,000. Generally, a Class E felony is punishable by a term of imprisonment of not less than one year but not more than six years. <br /> <br /> EXCEPTION<br /> <br /> Present law provides that it is an exception to the offense of intentionally or knowingly possessing, manufacturing, transporting, repairing, or selling certain listed items in present law if the person acquiring or possessing a machine gun is in full compliance with the National Firearms Act. This bill adds to this provision that it is also an exception to such offense if the person acquiring or possessing a switch or auto sear device, as described above, is in full compliance with the National Firearms Act.<br />
