Amends TCA Title 36, Chapter 3.

Present law prohibits a county clerk or deputy clerk from issuing a marriage license until the applicants make an application in writing, stating the names, ages, addresses, and social security numbers of both the proposed male and female contracting parties and the names and addresses of the parents, guardian or next of kin of both parties. This bill rewrites the provision above to provide, instead, that a county clerk or deputy clerk must not issue a marriage license until the applicants make an application in writing, stating the names, ages, current addresses, and social security numbers of both of the proposed contracting parties. An applicant under 18 must also include the name and current address of the parents, guardian, or next of kin of the applicant. Present law provides that if either individual is incarcerated, then the inmate must not be made to appear but must submit a notarized statement containing the inmate's name, age, and current address and a name and address of the inmate's parents, guardian, or next of kin. This bill removes the requirement that the statement include the name and address of the inmate's parents, guardian, or next of kin, unless the applicant is under 18, but does require the statement to include the inmate's social security number. Present law provides that if an applicant has a disability that prevents the applicant from appearing, then the applicant may submit a notarized statement containing the applicant's name, age, and current address and the names and address of the parents, guardian, or next of kin. This bill removes the requirement that the statement include the name and address of the applicant's parents, guardian, or next of kin, unless the applicant is under 18, but does require the statement to include the applicant's social security number.
