Amends TCA Title 3 and Title 4.
Present law provides that the commissioners of state government must be appointed by the governor for terms to expire with the beginning of the term of the governor next elected, or whenever their successors are appointed and qualified. Further, each commissioner holds office at the pleasure of the governor. This bill removes the provision about each commissioner holding office at the pleasure of the governor and provides, instead, that, prior to being eligible for appointment as a chief executive officer of an administrative department of state government, a person must (i) have resided in this state for a minimum of 30 days prior to the person's selection for the position and (ii) satisfy all statutory requirements for the position. This bill authorizes a person selected for such an appointment to be removed from the position for cause upon passage of a joint resolution of the general assembly by a two-thirds majority vote. Removal for cause may include, but is not limited to, the following while in office: (1) The commission of a crime or misdemeanor; (2) Knowing or willful misconduct; (3) Knowing or willful neglect of duties required by law; and (4) Failure to meet any qualification for the office as prescribed by state law.
