Amends TCA Title 71.
Under present law relative to vocational services to the blind and vending stands, "public property" means all property owned or leased by the state of Tennessee, or any county, municipality, or any other entity that is created by act of the general assembly to perform any public function. However, primary and secondary schools, and aeronautic entities, and their operations, are specially excluded from this definition. Further, institutions that are governed by the University of Tennessee system or the state university and community college system and their operations, are specifically excluded from this definition, except that the vending facilities presently in operation at such institutions on April 29, 1996, must continue to operate at their present locations or, if necessary, at a location comparable in terms of potential patronage, with the priority established by state law. This bill adds to the present law that property leased by a public entity to a non-governmental entity pursuant to a lease that conveys to the non-governmental entity the exclusive right to operate the property is also specifically excluded from this definition.
