SALE OF A FIREARM TO A MINOR<br /> <br /> Present law provides that it is a Class A misdemeanor to intentionally, knowingly, or recklessly sell, loan, or gift a firearm to a minor. A Class A misdemeanor is punishable by a term of imprisonment not more than 11 months, 29 days, a maximum fine of $2,500, or both, unless otherwise provided by statute. <br /> <br /> This bill increases the penalty to a Class D felony. A Class D felony is punishable by a term of imprisonment not more than two years but not more than 12, and the jury may assess a maximum fine of $5,000, unless otherwise provided by statute. <br /> <br /> Additionally, this bill adds that an adult who intentionally, knowingly, or recklessly sells, loans, or gifts a firearm to a minor is criminally responsible for any crime that occurs from the use of the unlawfully sold, loaned, or gifted firearm by the minor. <br /> <br /> INDUCE OR COERCE A MINOR<br /> <br /> This bill provides that an adult commits a Class D felony who knowingly induces or coerces a minor under 18 to commit one of the following offenses:<br /> <br /> (1) Theft of a firearm;<br /> <br /> (2) Robbery involving theft of a firearm;<br /> <br /> (3) Aggravated robbery involving theft of a firearm;<br /> <br /> (4) Especially aggravated robbery involving theft of a firearm;<br /> <br /> (5) Burglary involving theft of a firearm;<br /> <br /> (6) Aggravated burglary involving theft of a firearm; or<br /> <br /> (7) Especially aggravated burglary involving theft of a firearm.<br /> <br /> This bill takes effect October 1, 2024, the public welfare requiring it.<br />
