Amends TCA Title 59, Chapter 8, Part 3.

Tennessee HB0123 amends existing law regarding the reclamation of land adversely affected by past coal mining practices by modifying the process for filing liens on property. The bill affects property owners, particularly those who owned the surface prior to May 2, 1977, by requiring the commissioner of environment and conservation to notify them of a proposed lien and offering them the option to avoid the lien either by demonstrating non-involvement in the mining operation or by paying the specified amount. Additionally, it removes the restriction that limited the notice and lien filing process to cases where reclamation was conducted without landowner consent for public health and safety reasons.
